Apartment agent charged me $150 for replacement terrace door window glass without notifying me beforehand.?

REside in NYS rent stabilized one bedroom unit. When i requested the terrace door window repair, the Agent did not tell me that i would incur a cost for the window replacement. My "Replacement Apartment Lease" states "..Tenant must , at Tenant's cost, make all replairs and replacements whenever the need results from Tenant's act or neglect. Owner's reasonable expense will be added to the rent." I did not cause the window crack, therefore i should not have to pay the exorbitant $150 for the window replacement. What proof does the Agent have to provide to me, the tenant, that the damage was caused by me? Can i request the window glass bill to determine if the $150 is a reasonable expense? Are rent stabilized tenants liable for all repair costs, if the Agent does not provide proper notification about repair charges?

  1. First of all $150 is NOT exorbitant. That is a pretty reasonable window replacement cost. You can ask to see the bill. They can only charge you actual cost.

    Normal use of a place does not cause a window to break. If there have been no storms or break ins to account for the damage, then it is assumed you caused it.

    Rent stabilizing ONLY covers the rent amount. It would not protect you from paying for any damages.

    Sorry, but it sounds like you need to pay.
