Broken window replacement?

My brother recently broke a window at his highschool, accidentally. There are about 50 witnesses to this as it was in a locker are at the end of a lunch break. My brother has offered to cover the cost to replace the window. The window did not have safety film so the cost, according to average prices should have been around AU$300. The school originally accepted this offer. However, they are now deciding to charge him for glass with film, as they want to replace their old windows.This costs AU$450-$500. When he asked why this happened no one seemed to have a good reason. what legal rights do we have in this situation? We are willing to pay for the original window. Oh and it is a private school...if that makes a difference.

Well, I don't know if this would signify a precedent of any kind, but if the school were claiming for the window on their insurance policy, they would only get the money for the cost of reinstating the window to its pre-event condition. A safety film would be considered "betterment" and the school would have to pay the additional cost. I would imagine the same priniciple applies to your brother. After all, if he accidentally bumped another car and they decided to have a body kit fitted as well as the damaged bodywork, he wouldn't be expected to apy for that would he?
